New York law firm Rubin & Licatesi, P.C. announced today that they have secured a bad faith hearing on behalf of clients recently sued for foreclosure.
The Long Island foreclosure attorneys, also well-known for their services in loan modifications, represented defendant homeowners against plaintiff PHH Mortgage Corporation (Index No: 23668/10) in a pending New York State Supreme Court action in Nassau County. During the course of the case, the record showed that the plaintiff failed to discharge its responsibilities to the homeowners, and bank personnel lacked consistency and coordination. Therefore, the court imposed upon both parties an obligation to negotiate in good faith to achieve a “mutually agreeable resolution, including a loan modification” and ordered PHH to attend a hearing on these issues.
Attorney Richard Rubin stated, “We are pleased with the results and hope to see a final agreement based on good faith and benefiting our clients, with all to see that homeowners’ rights will be protected and preserved by our law firm.”
The proceedings were submitted to the Court in March 2012 and the decision was entered on April 27, 2012.
