New Regulation for FATA and PATA, PHC Lawyer has show concern

Peshawar , 18 July 2011 , The lawyers of Peshawar High Court have submitted a requisition for convening general body meeting of the association against the Action (in Aid of Civil Power) Regulation. Some of them also claim that they will challenge the regulations in the high court. The General Body meeting will be held on coming Saturday in Peshawar high court Bar Room.

According to the General Secretary of Peshawar High Court Bar Association Amin Ur Rehman, the member of Fata Lawyer association show concern about new regulation and next week we called for General Body Meeting, where the lawyer discuss the new regulation.

He said that in current situation security forces will use the power against people and they detain the people from cities and show them in FATA or PATA. Also under the regulation they detain people 120 days, which is ruthless.

He said that the new Regulation of (in Aid of Civil Power) create more awfulness in FATA and PATA, where situation is not good.

The prime objection against these regulations, which are almost identical except minor administrative changes, is that it provides for interning a person for unspecified period without production before any court of law.

According to new Regulation “action in aid of civil power” as a series of measures that involves mobilization of armed forces in aid of civil power or their requisition by the federal government, including measures such as armed action, mobilization, stationing etc, till such time they are withdrawn by the written order of the government

Section 11 of the regulations dealing with duration of internment states: “The power to intern shall be valid from the day when this regulation deemed to have come into force, or the date the order of internment is issued, whichever is earlier, till the continuation of action in aid of civil power.
