Lord Carlile’s Report on the UK being a “Safe Haven” for “International Terrorists” did not go far enough in terms of substance, or definition. However, it is a step in the right direction given the need to be Politically Correct or risk censorship. So let an independent put some muscle on this such that thinking people can understand the issues.
For “International Terrorists” read “Islamic Fundamentalist Terrorists”. The Basque Separatists (ETA), the Irish Republican Army (IRA) the Ulster Defence Force (UDF), the “Shining Path” and many other groupings that fall, or fell, under the “Terrorist” Label restricted their operations to their own locale. Most were even kind enough to give the Chaps a ring with a warning before they detonated a bomb. Try as I might, I can find only one Terrorist Grouping that operates Internationally, without regard for life, property, territory or target.
Let us drop Political Correctness and start by removing the word “International” and replace with “Islamic”, because that is what it is. QED. A list of the accomplishments of the “Religion of Peace” for November 2010 is appended to this. Since the 9/11 massacre at the World Trade Centre (and that is exactly what it was) the “Religion of Peace” have committed over 16,700 other acts of Terrorism Globally resulting in loss of life.
Lord Carlile rightly suggested rulings by the European Court of Human Rights had undermined efforts to deport dangerous individuals intent on causing mayhem.
Under Article 3 of the European Convention on Human Rights individuals are protected against torture, inhuman or degrading treatment. The clause allows foreign terror suspects to fight deportation on the grounds that they would be tortured in their home countries if returned. Then there is the “Stateless Provision”. In truth, Egypt stripped the Hate Preacher Abu “Hook” Hamza of his nationality pretty quickly, I find it inconceivable that they were not aware of the “Stateless” clause under our Immigration Act, but saw fit to dispose of a liability onto the UK. Well, let the USA have him under extradition, and the sooner the better. A large number of convicted terrorists hide behind the human rights or stateless clauses.
It is part of the strategy in the unelected halls of Europe to degrade this once proud Nation into compliance with the EU, without consultation or a mandate from the people. Some call this “Common Purpose”, I call it Treason. Why as a people, without being asked through Referendum, are we even listening to Europe? The simple answer is that Government is being autocratic and will not allow a referendum because the people will come back with a resounding “No”.
Dominic Raab, Tory MP for Esher and Walton, said European judges’ law making was ‘out of control’. He added ‘It is not the job of an international court to re-write British laws on deportation, parental discipline or prisoner voting. It is high time we drew a line in the sand.’ Well said Mr Raab, I concur completely.
Human rights campaign group Amnesty International said Lord Carlile’s suggestion of a "safe haven" was "outrageous". Given the source of the comment, this is hardly surprising.
The charity's UK director, Kate Allen, (Red Ken Livingstone's former Partner) said: "The global ban on deporting people to countries where they're at risk of torture exists for a very good reason - to protect us all from the threat of being tortured." Sorry, do not follow that logic at all. Well Ms. Allen, how about the torture that the families of those lost and injured in the 7/7 bombings suffer to this day? Where are their human rights? Go back to the World Trade Centre, and answer for that one as well? If a foreign National commits an offence in the UK, not only should they be deported on conviction to their homeland, but we should insist that they serve the term of their conviction in a prison within that Country. Not, as happens now, spend their term in a 5 Star, UK Prison, on three square meals a day, at a great cost to the UK Taxpayer, only to be given “Leave to Remain” at the end of this because of “Human Rights”. We have quite enough home grown convicts, without importing them.
She further said: "Signing unenforceable 'diplomatic assurances' with countries known to use torture already undermines the international ban on this abhorrent practice. What the Left wing Tree Huggers have forgotten is the reason that the bulk of these people head here is for that reason, and that alone. They have made themselves unwelcome in their home Country, so let us all head for the Garbage Can of Europe known in the Middle East and West Africa as the UK, those mugs will take us. Welcome to the UK. This way to the benefits office.
To make these provisions enforceable completely is very simple. Nationals from Countries that continually abuse the UK will find Visas for their Nationals increasingly harder to come by. Further, aid and assistance would be curtailed. They need us, we do not need them.
The European convention has been incorporated into British law in the Human Rights Act, without consultation with the people or so much as a whisper from Government. Yet a further example of unlawful prostitution of our Sovereignty by Government, to Europe? British courts have to apply rulings of the European court. Unelected European judges have since ruled in the 1996 Chahal judgement, that the only factor of importance was the protection of the human rights of terror suspects. How does this not subvert the rule of Law in the United Kingdom?
Last May, a court ruled that convicted Al Qaeda operatives Abid Naseer and Ahmad Faraz Khan could not be deported because it would infringe their Human rights. The fact that they were jailed for Terrorist Activity planned for the Arndale Centre in Manchester over the Easter holiday last year has no bearing on the judgement, thanks to the ECHR.
Judges ruled that Naseer, 24, and 26-year-old Faraz Khan - who came to Britain as students - should not be sent back to Pakistan because of the risk they could be tortured. The people of Pakistan are killing and torturing each other on a daily basis, so to follow this logic, we move them all to the UK do we? I do not think so.
The judgement by the Special Immigration Appeals Commission was frankly outrageous and Home Secretary Theresa May, while expressing disappointment, has done a spectacular amount of nothing since to rectify the problem. Meantime, we have two convicted terrorists walking the streets of the UK. Anyone want to take a bet that they will try it again?
The issue of human rights does not sit well within the coalition. Many Tory MPs are insisting the party should stick to its manifesto pledge to scrap the Human Rights Act, brought in by Labour, and replace it with a British Bill of Rights. Why? Scrap the Human Rights Act by all means, but we have the Magna Carta and the English Bill of Rights of 1689 already. These two pieces of definitive common law are superior to all Statute Law within the UK, and within these lies the right to “Lawful Rebellion”, The process of scrapping the Human Rights Act fell off the Tory manifesto after discussions with the Lib Dems over forming the Coalition. Along with promises to amend the Arbitration Act in a manner such that Sharia Courts could no longer hide behind it. Amazing the trade-off's made, the ideals lost, and the election pledges disregarded in the interests of gaining power in Government.
Politics is a dirty business. Tony Blair started it, Gordon Brown honed it, Cameron & Clegg seem to have perfected it.
Lawful Rebellion? I wonder if it will need to come to that before this Coalition Government respect, and listen to, the will of the people of this great Nation? Until we have a referendum on Europe, and membership thereof, there is no justified or legally binding place for European Law in the United Kingdom. The people that these laws effect on a day to day basis have never been asked for an opinion. It is high time that happened.
