In this June 17, 2010 file photo John Pistole testifies on Capitol Hill in Washington, Thursday,...

John Tyner may face a $10,000 fine and a civil lawsuit after he refused a body scanning at SAN airport. After refusing a pat down, John Tyner said to the TSA agent, "If you touch my trunk I will have you arrested."

The incident of John Tyner’s refusal to body scanning was caught on video.

Upon hearing the comment of John Tyner, the TSA agent said that he would have to involve his supervisor because of John Tyner’s comment. A female TSA agent arrived shortly at the place of the incident where she explained to John Tyner that if he refuses the body scanning process, he will have to get a pat down for checking purposes.

John Tyner at this point said to the TSA security supervisor that he will not undergo this "molestation" as he feels it is not a condition of getting onto his flight.
