Condominium builder, Robert Bruce Fazio was arrested and charged with offenses including: risking a catastrophe, recklessly endangering, fraud, and theft by deception. Similar charges will likely face Kier Property Management and Kier Construction, both subsidiaries of Ogden, based parent company, Kier Corporation for offenses including, endangering the lives of their own employees and the lives of the people who once lived here Below is the list of charges facing Fazio, with links to pages containing evidence of Kier's offenses that could easily apply under each of these charges. Theft by Deception:
- Although Kier was responsible for having the building re-piped with defective "Poly Tubing", they deny having any knowledge of the class action lawsuit that resulted in Poly Tubing being found to be defective. Kier also denies having any knowledge of the final disposition of that lawsuit, in which the pipe's manufacturer would have replaced the defective pipe, free of charge. For a huge construction company like Kier, to claim that they have no knowledge of this information would be similar to someone living in New York City on September 11, 2001, to claim that they have no knowledge of the events of 9/11.
- Rather than addressing the Poly Tubing issues at the building, Kier chose to do nothing and then sold the building to me without disclosing this information.
