Today James Brokenshire Home Office Minister announced that half the money confiscated through the Proceeds of Crime Act went back to the very organisations responsible for prosecuting Defendants.
James Brokenshire said " The Home Office received a total of £150 million of criminal assets in 2009-10 after receivers' fees had been deducted. Under the current Asset Recovery Incentivisation Scheme half of all assets recovered are returned to law enforcement agencies involved in the asset recovery process, including the police, Crown Prosecution Service and HM Courts Service.
In 2009-10, £75 million was returned to front line agencies"
This means that the Police the Crown Prosecution Service and invidiously also the Courts themselves get a cut of anyone caught up in the proceeds of Crime trap. Making a mockery of the Criminal Justice System where the prosecutors stand to gain financially from a suspects conviction.
This would be fine if it really was taken from drugs barons an d terrorists but this money is in the main part coming from hapless small business men and women caught up in a system that wants to fleece them of their life savings and their property.
Recently a lady lost her life saving of £11,000 because she unwittingly purchased products for her business for £250 that were stolen by a supplier. The supplier of the stolen good being on benefits was fined £1.
Another lady, who's former boyfriend was on remand dying of Muscular Dystrophy accused of obtaining money by deception from his wheelchair, has been driven to attempt suicide by having a restraint order placed on her house because her former boyfriend spent all his money.
Then there is the total abuse of the Proceeds of Crime Act which Mr Brokenshire is well aware of , the use of search and seizure powers under the Act to seize documents damaging to the Government.
It is not those guilty of major crimes who are being destoryed by the Proceeds of Crime Act but the innocent and hapless and those the Government fear.
Be warned it can happen to you because with the Proceeds of Crime Act they do NOT need any evidence to take everything you own just a mere suspicion or connection with someone who may have committed a crime.
