Dear Mr Lovric
I refer to your letter applying for replacement payment for pension payment on 28 December 1972 and 11 January 1973. The Department is unable to replace these two payments as there is insufficient information available to establish the liability on the claim due to the passage of time involved. The authority for this decision is under Finance Direction 34/23 Statutes of Limitations. This decision was made by a delegate of the Secretary under the Social Security Act. If you think the decision is incorrect you can phone Mrs J Rogers on 897.0777 to talk about it. She will check that all the facts have been considered and tell you why the decision was made. If you still disagree, you can talk to an Authorised Review Officer who is a senior, independent, expert officer who can:
. take a fresh look at the case:
. change the decision if it is incorrect:
. tell you how you can appeal if you still disagree: and
. tell you about your rights to see your file.
You can also appeal directly to the Social Security Appeals Tribunal who will independently review your case. If the Review Officer agrees with you, or your appeal and you are successful, arrears can be paid for the whole period since the three months of the date of this letter. Otherwise, arrears can only be paid from the date you appeal or ask for a review.
Yours sincerely
Debbie Weise
