NYPD Detective Refuses Breathalyzer Test After Killing Pedestrian

NYPD detective Kevin Spellman was taken into custody early Friday morning after running over and killing an elderly pedestrian. The 22-year department veteran smelled of alcohol and refused a Breathalyzer test, but his blood was taken at a local hospital several hours later. He was off duty at the time of the accident which occurred around 6:30 a.m.

Spellman, 42, was driving his 2009 Chevrolet Impala when he slammed into the woman as she was walking along the street. He immediately came to the woman's aid and asked for witnesses to call 911. She was pronounced dead at St. Barnabas Hospital.

The veteran cop had finished his Thursday shift at midnight. He was due back on the job at 2 p.m. Friday. Although he was taken into custody, he has yet to be charged.

This crash is similar to one that happened about a month ago after Police Officer Andrew Kelly ran down a minister's daughter in Brooklyn, New York. She died shortly after the accident.

Like Spellman, Kelly refused to take a Breathalyzer, and it took authorities seven hours to get a blood sample from the cop. Kelly faces up to seven years in prison if convicted.

    These police officers know they can refuse the breathelizer test so they have less evidence agains them. They also seem to stall on the blood tests, meaning it has time to get out of the system. You would think with everything they see day in and day out that they would not drink and drive. Very sad.

    What a horrible and sad incident. There are too many reports of cops killing innocent people. It's in the news all the time, and it's unacceptable. There's crooked police, irresponsible police, racial profiling, etc. These officers are supposed to be out there to protect the public. Instead, many of them are major threats. The police departments need an overhaul and some serious regulation. Condolences to the family of the victim.

    This kind of incident gets me VERY VERY VERY VERY UPSET, people. I am SICK AND TIRED of these idiot cops who THINK THEY ARE ABOVE THE LAW and who do things like this. Ladym33 and InspectorGadget, you've made some good points. "To protect and serve"??? Yeeeaahhhh, right! I almost laugh when I see that logo on a police car nowadays, because some of these cops aren't out to serve the public, it's ALL ABOUT THEM. They think they can do ANYTHING just because they have a badge.

    Granted, NOT ALL cops are crooked but for the ones who ARE, they spoil it for everybody. We're seeing more and more cops doing stuff like this. It ain't right, it just isn't.

    Officer Spellman, SHAME ON YOU, sir.

    I hope the family members of the victim get justice in this case. My prayers are with them.

    I agree with you, jillcurtis. Once upon a time, police officers were the MOST TRUSTED of public safety officials-- now they are NOT. You know who is number one now? Firefigthers!! When is the LAST TIME you heard about a firefighter doing crazy stuff like this??

    I know there are good police officers out in the world, but it's hard to know what to believe when you read so many stories about police corruption. They are getting paid to protect us, when we need to be protected from them. I don't mean all police officers, just the scam officers.
