The CDC says, "The 2009 H1N1 influenza vaccines are expected to have similar safety profiles as seasonal flu vaccines, which have very good safety track records...." http://www.cdc.gov/h1n1flu/vaccination/vaccine_safety.htm

When someone gets sick after a vaccine, we are told that flu shots and vaccines safe for the vast majority of people. But what about the few, like Desiree Jennings, a Washington Redskins cheerleader and avid runner, who suffered a "rare side effect" or "adverse reaction," if you want to choose a benign sounding euphemism. The truth is that Desiree now has a rare neurological disorder called Dystonia which was caused by the seasonal flu vaccine. She has difficulty walking, talking and eating because of muscle spasms and convulsive movements. Woman Disabled by Flu Shot Reaction, Published : Tuesday, 13 Oct 2009, 11:27 PM EDT, by CLAUDIA COFFEY, My Fox DC, http://www.myfoxdc.com/dpp/health/101309_woman_disabled_by_flu_shot_reaction_dystonia

I am not one that cries "Sue him!" at every slip or fall. But given the clarity of the connection to the vaccine, and the severity of the illness and the life changes in Desiree’s situation, she should have no difficulty suing somebody - at least the vaccine maker- right? Wrong. Though Desiree may qualify for a set compensation amount via VICP (see below), anyone she may even think of suing is protected. Everyone is protected but Desiree, the one harmed. Interesting.

The CDC website states "The most common side effects following flu vaccinations are mild, such as soreness, redness, tenderness or swelling where the shot was given." http://www.cdc.gov/h1n1flu/vaccination/vaccine_safety.htm

Without outright stating potential effects that actually go well beyond soreness and redness, the site does go on to "answer" (or more accurateley completely discount) questions about negative claims and issues surrounding vaccines, such as the presence of thimerisol as a preservative (or mercury "free"/trace amounts), Guillain-Barré syndrome (GBS) and the use of adjuvants.

So doctors, nurses, pharmacists, schools, teachers, politicians, community centers, the government and the President all tell us to get vaccinated and that it is completely safe (thought he President and his family has not been vaccinated according to Associated Content: http://www.associatedcontent.com/article/2313979/obama_needs_first_family_to_publicly.html

On top of all those people we trust, every news source this side of heaven tells us vaccines are safe and insists anyone ‘at risk’ should get the H1N1 Swine Flu version. So it must be safe, right? If we’re giving it to sick children and pregnant mothers nobody would risk suggesting the vaccine only to have something go terribly wrong - unless each and every one of these people and groups is completely protected in saying it is safe, even if it turns out that it is not. If the government is strongly suggesting this all out media blitz and fear protocol then those who have the role of making it happen want to be ‘protected,’ or shall we say ‘immunized’.

Would you feel so safe if you knew that every last one of those groups, from the "Program Planners" such as community centers and the US Federal Government on down to the vaccine manufacturers themselves, have tort liability immunity? They can’t be sued if something goes wrong (unless willfully done so).

Why do all these people, companies and the United States Government need this kind of protection if the vaccines are so safe that soreness and redness are the only things we have to worry about? Maybe because they (all of the above and in particular the manufacturers) would not manufacture and promote the vaccines quite so vociferously (especially regarding the various currently untested H1N1 Swine Flu vaccines) if they thought they might be held accountable for "adverse reactions" and "side effects" like: slipping and falling while you’re waiting for the vaccine or leaving the facility, "death; physical, mental, or emotional injury, illness, disability or condition; fear of physical, mental, or emotional injury illness, disability, or condition, including any need for medical monitoring; and loss of or damage to property, including business interruption." www.flu.gov/professional/federal/vaccineliability.html

"The Public Readiness and Emergency Preparedness Act or PREP Act is a federal law that authorizes the Secretary of Health and Human Services to issue a declaration to provide tort liability immunity (except for willful misconduct) to individuals and organizations involved in the development, manufacture, distribution, administration and use of countermeasures against pandemics, epidemics and diseases and health threats caused by chemical, biological, radiological, or nuclear agents of terrorism." "On June 15, 2009, Secretary of Health and Human Services Kathleen Sebelius extended the PREP Act declaration for pandemic vaccines to H1N1 vaccines, and amended the declaration...to add provisions that can help H1N1vaccination campaigns." www.flu.gov/professional/federal/vaccineliability.html

You would think we, as a people, would have some sort of protection against the inability to sue for harm done to us at the suggestion, or perhaps very soon the requirement, of our own government. We do. "Vaccines are covered only when they are administered and used as 1) licensed or approved by the Food and Drug Administration (FDA); 2) authorized for investigational use by the FDA; or 3) authorized under an Emergency Use Authorization (EUA) by the FDA. On September 15, 2008, the FDA approved four vaccines against H1N1 that are covered by the declaration."

My first reaction is INVESTIGATIONAL? You are "investigating" on the entire country? Or perhaps on the world? I believe the intent of #2 is for drug trials and application of the scientific method of years of study to obtain FDA approval, prior to mass use. This has clearly not occurred with these drugs.

My second thought is relief that we must be safe so far, as we have not yet entered a state of Emergency. But silly me - it was declared nearly before it all began. "The Acting HHS Secretary's April 26 declaration of nationwide public health emergency caused by H1N1, which was renewed by the HHS Secretary on July 24, can be used by "Authorities Having Jurisdiction" to begin their public health and medical response." www.flu.gov/professional/federal/vaccineliability.html And just a few days ago, on October 23rd, President Barack Obama declared a National Health Emergency."

So the vaccines are protected in every possible way while I am stripped of my rights to seek redress in our court system if I am one of those "few" who do not respond well. BUT, if I were to tell you to on my personal website to try using, say, colloidal silver, or some other natural treatment for H1N1 Swine Flu that has not been through the entire FDA process (neither have the vaccines), I can be prosecuted and put out of business if it is my product. Within the last 2 weeks the FDA has...with the Federal Trade Commission (FTC), issued a warning letter to a Web site marketing fraudulent supplements that claim to help prevent the spread of the H1N1 virus. The letter advises the site’s owners to discontinue marketing the products or face legal action."

http://www.fda.gov/ForConsumers/ConsumerUpdates/ucm187728.htm

So my suggestions are obvious - if they won’t let you sue, there must be a history of people wanting (needing) to. Read between the lines and just don’t do it. And regarding the colloidal silver, of course I would never, ever say it treats swine flu. I have no experience in that department. It’s just helped me in the past, personally, (I am not a doctor, I cannot treat....) with strep throat and Epstein Barr Syndrome. Good luck, and may your own immune system win!

If you have a negative reaction to any kind of vaccine, it is important to report it to: VAERS: http://vaers.hhs.gov/index

"The Vaccine Adverse Event Reporting System (VAERS) is...is a post-marketing safety surveillance program, collecting information about adverse events (possible side effects) that occur after the administration of vaccines licensed for use in the United States...by which adverse events following immunization may be reported, analyzed, and made available to the public."

To see if you qulaify for compensation for a vaccine injury go to: www.hrsa.gov/vaccinecompensation/default.htm for the National Vaccine Injury Compensation Program (VICP)

To Learn more about Dystonia (definition, symptoms, possible causes, etc.) go to: http://www.mayoclinic.com/health/dystonia/DS00684
