Centre to delegate its powers on MCD to Delhi Government 18:16 IST The Delhi Municipal Corporation Act, 1957 confers a number of powers on the Central Government. Most of the powers have been delegated by the Central Government to the Lt. Governor of Delhi.
There have been numerous requests from time to time that the powers of the Central Government ought to be delegated to the Government of National Capital Territory of Delhi (GNCTD). Recommendations to this effects have been made by the Balakrishnan Committtee, the Virendra Prakash Committee, the Ashok Pradhan Committee and the Omesh Saigal Committee, and more recently by the Second Administrative Reforms Commission chaired by Sh. Veerappa Moily.
The Central Government has consulted the GNCTD, the Lt. Governer of Delhi and the Municipal Corporation of Delhi.
After careful consideration, the Central Government has decided to delegate its powers and many of the provisions of the Delhi Municipal Corporation Act, 1957 to the GNCTD. In some cases, the power has been delegated subject to the condition that the power may be exercised or the order passed with the previous approval of the Central Government. However, some powers of the Central Government will continue to be delegated to the Lt. Governor.
The Central Government will observe the working of the Delhi Municipal Corporation Act, 1957 after the revised delegation of powers and will consider delegation of further powers for the relaxations of conditions at an appropriate time. (EOM)
