Tacloban City, Philippines --- Two of the wanted foreigners in Region 8 has been arrested recently by agents of the law.
The suspect was identified as Charles Blair Wissenger, alias Chuck, an American national, who is in his early 60s, was arrested by elements of the Criminal Investigation and Detection Group (CIDG) regional office 8 based on a warrant of arrest issued by the court here for violation of Sec. 5 (b) of R.A. 7610- a crime he allegedly committed on January 17, 2008.
Wissenger was freed temporarily on bail amounting to P200,000.00. The other suspect is identified as Gordon Vincent Winzar, with the same offense, who reportedly was able to flew out of the country prior to the issuance of the warrant of arrest.
R.A. 7610 is an “AN ACT PROVIDING FOR STRONGER DETERRENCE AND SPECIAL PROTECTION AGAINST CHILD ABUSE, EXPLOITATION AND DISCRIMINATION, AND FOR OTHER PURPOSES.
Sec. 5. Child Prostitution and Other Sexual Abuse. - Children, whether male or female, who for money, profit, or any other consideration or due to the coercion or influence of any adult, syndicate or group, indulge in sexual intercourse or lascivious conduct, are deemed to be children exploited in prostitution and other sexual abuse.
“(b) Those who commit the act of sexual intercourse of lascivious conduct with a child exploited in prostitution or subject to other sexual abuse; Provided, That when the victims is under twelve (12) years of age, the perpetrators shall be prosecuted under Article 335, paragraph 3, for rape and Article 336 of Act No. 3815, as amended, the Revised Penal Code, for rape or lascivious conduct, as the case may be: Provided, That the penalty for lascivious conduct when the victim is under twelve (12) years of age shall be reclusion temporal in its medium period;”
Ms. Carmela Bastes, Social Worker-and officer on case, said, the crime involving both Winzar and Wissenger took place on January 17, 2008 around 9 p.m. when the duo picked up two minors girls, aging 15 years old, and lured them with certain amount in exchange of sexual intercourse.
On the affidavit of the two complainants, they said, inside the suspects’ closed van, they were forcibly ordered to do the lustful act but they resisted-and as a consequence of their refusal they were maltreated.
They parked the van in the dark portion inside the compound of a known hotel here- but when they were moving out- a team of policemen and social workers blocked them at the gate and subsequently arrested the suspects, rescued the victims.
Ms. Milagros “ Mila” Repulda, Alien Control Officer, Bureau of Immigration and Deportation (BID) regional office 8, disclosed that there are over 500 aliens in the entire region- and all of them, she said, have been constantly updating their papers before their office.
Except for Winzar and Wissenger, who, since the month they were involve in the case in early 2008 have not shown their faces in BID office until the warrant of came out lately this year, she said.
The BID office was furnished with the copy of the warrant of arrest, but according to Repulda, they forwarded the copy to BID Comm. Marcelino “Nonoy” Libanan for appropriate action.
