Janet Jackson FCC Super Bowl Mishap Fine Tossed Out

Janet Jackson's 'wardrobe malfunction' during the 2004 Super Bowl halftime show on CBS which was fined by the Federal Communications Commission $550,000 for indecency has been thrown out by a federal appeals court. A panel ruled yesterday that the FCC "acted arbitrarily and capriciously" when they issued the fine for the nudity which lasted only a half second. The court claimed the FCC deviated from their 30-year practice of fining indecent programming.

During the Super Bowl halftime show watched by 90 million people, Justin Timberlake sang, "Gonna have you naked by the end of this song," and the wardrobe malfunction happened when he reached for Janet's bustier.
