Shortly after talk show host and comedian Ellen DeGeneres announced that she would be the fourth judge on the popular music reality show "American Idol", the producers of the talk show were sued by a number of record companies for playing songs on the show without permission.

According to the suit filed in the US District Court in Nashville the show's producers used some 1,000 songs since the beginning of the show in their dance over segment when Ellen "dances" from the stage over to the area where she interviews guests. The music was played by the show's own DJ.

Ellen DeGeneres herself was not named in the suit.

Some of the record companies who filed the law suit include Atlantic, Capitol, Motown, Sony, Virgin, Warner, and Arista Records.

The amount of damages being sought by the companies were not mentioned.

What? Can someone sue me if they walk down the street and I'm playing their CD on my front porch? I didnt call Madonnas record company today and ask to play their music, I guess I'm in trouble. Can all radio stations and nightclubs be sued by record companies for playing music? What makes that any different? This is weird. You have to have permission to play music now? I thought that it was good advertising to have your music played, especially on tv. Whats to sue about? Ive never heard of such a thing. This better get thrown out or we all better watch out playing music in our cars and homes. CRAZY

I'm with you, anytime an artist's music is played it's like advertising, but the record companies see it differently; they want anyone who plays music for anything other than personal enjoyment to obtain permission and pay a fee. There's a law in Congress now to make radio stations pay artists when they play their songs on the radio.

This is the same problem that Paul Mcartney had when he started his tour. His Beatle's hits were owned by Michael Jackson and when Jackson was alive, he refused to sell that catalog of music to McCartney. McCartney was fuming that he had to pay Jackson and now his estate for using his own songs that he had written.

I always wondered if she had gotten permission. You always have to if you are making money from using the music. If you are not making money from it then you can use it. Ellen DeGeneres was profiting. Oh well.

I just think its extremely sad. I dont think shes profiting in any way from playing a song and dancing around to it having a good time. If anything, shes promoting the CD and people that like it will go buy it. They're getting free advertisement. If that's not biting the hand that feeds you. If you watch her show, you can see that she knows all the words to the songs, and that she really likes it, and most likely has the CD at home. It would be great if people retaliate and just stop buying CD's all together. Then we'll see who profits. It kills me what the world has resorted to, hurting people for their own benefit. Its everywhere you go!

If anything, Ellen is both enjoying and promoting the songs. Countless times, I've heard some song played during Ellen's dance segment and gone to find it.

I also think that Ellen's show does only positive acts. If anyone's watched it, they know the community service acts she performs for low-income college students or a recently laid-off mother with four young children. She brings comedy to a person's afternoon as she lounges in her living room, and she brings happiness and support to a struggling person. And now, her show gets sued for something that is incredibly miniscule with regards to the impact of her show?

I think this is all related to bad feeling betweent the record labels and Simon Cowell for some reason. Ellen just caught in the middle of the war:-(

Some artists like it when people play their stuff, they see it as free advertising but it's the record companies who are really being a royal pain. I interviewed a band that encouraged their fans to share the music because it got them more fans to pay for the shows; smart move.

McCartney will get the last laugh. Not long ago I wrote an article about how the copyrights will start running out in a few years and the rights return to McCartney.

As long as you do not make any money from it. For example, it is a paying party at your place OR You use the songs in an act you are doing where you get paid.

I understand what you are saying Searcher, and if this is the case, then hopefully the judge will determine that Ellens show will have the same amount of viewers whether or not she plays a song at the opening of each show therefore determining that she is not making any money or profiting in any way by playing the music therefore dismissing the case. If shes not making money off of it, which its absurd to think the show would go under without that opening dance, then the record companies dont have a claim and hopefully they waste alot of the courts time and money and make an ass of themselves.

The suit was filed on Wednesday morning and Ellen announced her new gig as a judge during the taping of her show on Wednesday afternoon and that's when the story broke. It was just bad timing that both events happened on the same day.

If it is a paying event but you don't get paid as in a charity event you still need to get permission to use the songs.

I guess the law is the law, but these record companies are obviously trying to get easy money. Playing those songs on a major television show like Ellen's will help them rather than hurt them. But like I said, the law is the law, so the producers should have known better. On another note, why is Ellen going to be a judge on American Idol? She obviously does a great job on her show, but is she really qualified to judge anyone's musical ability? These contest/reality shows are a joke.
