The New York Police Department released Thursday a surveillance video showing Lindsay Lohan either clipping or just about missing a man walking in front of her car as she tries to roll into a parking garage for the Dream Hotel.

The blurry video shows a crowd gathering about outside, as a car's headlights come into view. A man wearing a plaid shirt walks by, and is not sure either he was hit by the car, or leaped out of the way, as the car passed through the crowd.

The man then runs into the parking garage after the car, a Porsche Cayenne reportedly to be driven by Lohan.

Later the man identified himself as cook Jose Rodriguez and told the media that Lohan smelled of alcohol. But witnesses said the actress had not been drinking just minutes before the said incident.

When she came out of the plush hotel about 2 a.m., she was arrested for hit and run accident, and was released with a desk appearance ticket, and is due in court on Oct. 23.

Steve Honig Lohan's rep has denied she had struck anyone, and added he looks forward to the matter being resolved.
