Geo Reports-Balochistan Case-06 Sep 2012

Interior Secretary appeared before the Supreme Court on Wednesday on a very short notice. Chief Justice Iftikhar Chaudhry notified him that the Balochistan case would be given the utmost importance as the province is currently in a disastrous form because of the unrest.

The Balochistan unrest case was heard by a three-member bench of the Supreme Court on Wednesday. The hearing saw strict exchange of words between CJ and the Attorney General Irfan Qadir. CJ objected over the Attorney General’s appearance in the Court, stating that ‘why had he appeared when he was not called upon’.

Irfan Qadir responded to this by stating that he had appeared before the court after receiving orders.

The hearing commenced and the Chief Secretary submitted the report with respect to the law and order situation within the province. SC rejected the report terming it to be a formal proceeding.

The bench was seen enraged over the absenteeism of the Interior Secretary. The Bench stated that if the Interior Secretary did not present himself within the Court, arrest orders would be issued against his name. These strict words of the SC saw the Interior Secretary appear in the Court within half an hour.

Counsel for the Frontier Constabulary (FC) S.M. Zafar stated that foreign element were traced within the Balochistan unrest and that is why the culprits are not easily apprehended. “It is impossible for the law enforcement authorities to save the life of each and every individual,” stated Zafar

He added that a change in the law was much needed at this time and there are certain issues that would have to solved by holding talks.

Responding to this, Justice Arif Khilji said that if issues were to be resolved via the Jirga system, then Courts should be closed. He added that people were freed after paying ransom and that is certainly not justice.

“Why is this case been prolonged?” AG Irfan Qadir was later seen questioning the SC bench.

The bench replied to this by stating that the province was burning because of the deteriorating law and order situation and its is for that reason this case would be given the utmost importance.
