A Top U.S. Court Allowed the Execution Of Texas Inmate

The US Supreme Court refused to stop the Tuesday's scheduled execution of a low IQ Texas inmate who has been diagnosed as mentally ill person, a decade after imposing banning execution of such people as cruel and unusual punishment.

Marvin Wilson, 54 was convicted of murder for the November 1992 Killing of a 21 year old Police informant, Jerry Robert William, and was since April 1994 been sentenced to death.

The defendant had challenged his execution as unconstitutional according to the 2002 decision Atkin V. Virginia, that banned completely executing mentally illness people but gave the State some discretion in dealing on the issues and who's qualified for that protection.
