Following two lawsuits against the Cook County Clerk David Orr claiming that not issuing marriage licenses to gay and lesbian couples violates the due process and equal protection clauses of the Illinois Constitution, the Cook County State’s Attorney’s office said that the state's ban of gay marriage was unconstitutional.
