During a special session Wednesday, the Supreme Court voting 11-3 upheld the P1.8-billion contract COMELEC signed with supplier Smartmatic-TIM to purchase some 82,000 PCOS (precinct count optical scan) for the country’s May 2013 midterm elections. The poll body is now at liberty to implement the contract., SC spokesman Gleoresty Guerra informed reporters. Guerra likewise said the high court has lifted the restraining order it issued on April to stop both parties from enforcing the contract.

COMELEC Chairman Sixto Brillantes welcomed the high court decision.

The favorable 11-3 vote of the Supreme Court that paved the way for the upholding of the COMELEC’s decision to buy 82,000 PCOS machine is an aftermath of the ouster of former CJ Renato Corona, a lawyer representing the petitioners said.
