As part of a deal with prosecutors, an unnamed 9-year-old boy who was charged in the accidental shooting of his classmate at Armin Jahr Elementary School in Bremerton, Washington had agreed on Tuesday to testify against his mother and her boyfriend on weapons offenses, report says.
A warrant of arrest was issued to the boy’s mom on Monday, Jamie Lee Passmore including her boyfriend, Douglas Bauer as they were to blame for leaving the gun unattended, said police in Bremerton, Wash.
Lt. Peter Fisher told Reuters that Passmore is charged with two second-degree counts of unlawful possession of a firearm and Bauer is wanted for a second-degree count of unlawful possession of a firearm. The boy who remain in the custody of his uncle, Patrick Cochran, was also ordered not to have contact with them
"We'll cooperate with law enforcement even if it leads to the boy testifying against his biological mother," defense lawyer Eric John Makus told Reuters.
The third-grade boy confessed to the court that he brought the gun with him in school, a.45-caliber semi-automatic pistol. Cochran, his uncle also said that he was bullied in school and so he brought the gun to defend himself.
At Kitsap County juvenile court, the boy had admitted his wrongdoing of critically wounding his classmate, Amina Kowcer-Bowman, 8, when he slammed his backpack on a desk and the gun inside it was discharged.
The boy was guilty for unlawful possession of firearm but was dropped into third-degree assault charges by prosecutors. Part of his sentence was for him to undergo a 48-hour counseling and 12 months probation. Also, he was ordered by the court not to have contact with the victim and to write a letter of apology.
When asked by the judge if he wanted to say anything, he just said, “I’m sorry.”
Since the accidental shooting on February 22 that wounded Bowman in her midsection and arm, the girl had underwent 5 surgeries in Seattle hospital and still in serious condition, connected on a ventilator to help her breathe.
Reuters also reported that a court document shows the criminal and drug abuse record of the boy’s parents.
