atlanta journal constitution - obama elected president

Things are heating up in the race for the White House. A Georgia administrative law judge, Michael Malihi on Thursday denied a motion by attorney's representing President Obama to quash a subpoena requiring the nation's 44th President to appear in an administrative hearing seeking to have his name removed from the Democratic Primary ballot on Super Tuesday.

Two Georgia residents filed a motion questioning whether President Obama met the constitutional requirement to be president. Deputy Judge Malihi had previously set a hearing date on their petition for January, 26, 2012 in the Fulton County Superior Court.

Last weeks Court Order came as a result of a subpoena which the plaintiff's served upon President Obama directing him to present himself for questioning on the matter before the court.

Lawyers for the president filed a motion to quash the subpoena. Judge Malihi denied the president's motion, thereby setting up an unprecedented demand for a United States president to appear before a state administrative board.

It is not certain if the president will comply with the subpoena. Should he disobey a Court Order he might be subject to imprisonment in the State of Georgia until he decides to appear in court and give testimony regarding the circumstances of his birth. It should be noted that the late civil rights activist Hosea Williams once won a seat in the Georgia House of Representative from a Decatur jail cell. Also Dr. Martin Luther King, Jr's arrest in Decatur, Georgia lead to a telephone call from Bobby Kennedy to Mrs. King that turn the 1960 presidential election in favor of John Kennedy and lead to a mass exodus of blacks from the Republican Party.

It also poses the specter of a stand-off between the Georgia Bureau of Investigations and the Secret Service should Judge Malihi send them to the White House to physically bring President Obama before his state administration board. A constitutional crisis is ahead of us, as sure as, the Republican's abject failure to vet a candidate of good moral fiber, who can stand on the stage and go toe to toe with President Obama in a live Presidential Debate becomes crystal clear.

One wonders why all the legal wrangling to keep President Obama off the ballot, if he has as a matter of fact done a terrible job as President of the United States of America?

Veronica Roberts, your refrain seems to be the consensus among the people I've talked to tonight. I will be in the courtroom to see how this drama plays out on Thursday.

Are these the "birthers" again?
What an incredible waste of time and money for the tax payers of Georgia.

Please keep us updated on this scam.

The lead plaintiff claims he just has some doubts and want to put the issue to bed once and for all. I plan to be in court on January 26 and will file a report of what takes place.

Can't wait to hear what comes of this idiocy. Did that judge buy his job for I cannot believe anyone worth their title would be this dumb or let their personal bias cloud their judgement.

This judge was appointed back in 1995 by then Governor Zell Miller (D). Miller served in the U. S. Senate for several terms before stepping down. He later blasted the Democratic Party and gave his seat over to the Republicans. He pretty much voted with the Republican Caucus during his tenure in the Senate.

Silly judge. Silly people. Must be something in the air or water that's diminishing Americans' mental capacity. Although I suppose this strange behavior isn't limited to just the U.S. The whole world seems to be losing touch with reason.

Yea, winds7seas, it does seems to be a grim reality check going on.

DESINYDIOGENES, failure to obey a court order in a civil matter can subject the citizen to Contempt which could lead to a six month stay in the county jail. Is it likely hmmmmmmmmmmmmmm

That last question is right on point. Why take him off of the ballot if they claim he is doing so poorly?
Reply By hmichaelharvey Harold Michael Harvey | 4 months ago
Adrian Holman, yea, how about that one. If anybody on the other side could easily win, why all the trouble and bother?

Don't we have an election coming up? Thought so.....
Reply By hmichaelharvey Harold Michael Harvey | 4 months ago
Yes there is an election coming up, which is the point of this court action to remove President from the ballot in Georgia and several other states. If you are so sure President Obama will not be re-elected in November, why all the fuss?

I don't mean to demean anyone, including an acquaintance who was an ALJ, and I'm not an attorney, but come on, an administrative law judge!? It's as transparent a case of b.s. on the judge's part as those who filed the motion. There may be a precedent for a sitting president defying a subpoena, if memory serves me. (Nixon/Watergate?)
Posted By hmichaelharvey Harold Michael Harvey | 4 months ago
Jimiham, good point. Nixon has less basis to refuse a congressional subpoena than President Obama does in an administrative hearing before the Georgia Department of Revenue.

Looking forward to your reports from the Courtroom on Thursday Mr. Harvey. It is just unbelievable how much our President is disrespected by these uneducated racist fools. Thank you so much for all that you do Sir.

Ms. Edge, I the Tea Party is encouraging their members to attend. I hope I can get a seat for this show oh, I mean hearing.

I feel this is a bunch of bull. Why isn't Bush or Chaney being summoned to appear? Would this not be a thing to do? Better yet, since there was so much concern regarding the President of United States, place of birth, why isn't Donald Trump being brought to this same court. Why isn't this judge being censored. Why is this a concern. The people have a right to know. Disbar this idiot, is this a United State Citizen?
Reply By hmichaelharvey Harold Michael Harvey | 4 months ago
President Obama in an act of moving the country forward elected not to pursue Bush and Chaney and the Justice Department has not put forth any effort to investigate them further.
Posted By smoorer56 smoorer56 | 4 months ago
This is a waste of tax payers money. Who is paying THIS ALJ.

The State of Georgia or at least the taxpayers of the State of Georgia.
