Things are heating up in the race for the White House. A Georgia administrative law judge, Michael Malihi on Thursday denied a motion by attorney's representing President Obama to quash a subpoena requiring the nation's 44th President to appear in an administrative hearing seeking to have his name removed from the Democratic Primary ballot on Super Tuesday.
Two Georgia residents filed a motion questioning whether President Obama met the constitutional requirement to be president. Deputy Judge Malihi had previously set a hearing date on their petition for January, 26, 2012 in the Fulton County Superior Court.
Last weeks Court Order came as a result of a subpoena which the plaintiff's served upon President Obama directing him to present himself for questioning on the matter before the court.
Lawyers for the president filed a motion to quash the subpoena. Judge Malihi denied the president's motion, thereby setting up an unprecedented demand for a United States president to appear before a state administrative board.
It is not certain if the president will comply with the subpoena. Should he disobey a Court Order he might be subject to imprisonment in the State of Georgia until he decides to appear in court and give testimony regarding the circumstances of his birth. It should be noted that the late civil rights activist Hosea Williams once won a seat in the Georgia House of Representative from a Decatur jail cell. Also Dr. Martin Luther King, Jr's arrest in Decatur, Georgia lead to a telephone call from Bobby Kennedy to Mrs. King that turn the 1960 presidential election in favor of John Kennedy and lead to a mass exodus of blacks from the Republican Party.
It also poses the specter of a stand-off between the Georgia Bureau of Investigations and the Secret Service should Judge Malihi send them to the White House to physically bring President Obama before his state administration board. A constitutional crisis is ahead of us, as sure as, the Republican's abject failure to vet a candidate of good moral fiber, who can stand on the stage and go toe to toe with President Obama in a live Presidential Debate becomes crystal clear.
One wonders why all the legal wrangling to keep President Obama off the ballot, if he has as a matter of fact done a terrible job as President of the United States of America?
